Just in: Oscar Pistorius appeal granted

Judge Thokozile Masipa has granted an application to appeal Oscar Pistorius’ conviction.

The state can only appeal the sentence through the Supreme Court of Appeals. However, the state has not yet confirmed whether it will appeal both the sentence and the conviction.

Although Masipa has ordered the state to pay COSTS for the sentence appeal, it is ultimately still a victory for them.

The state’s main argument is that, “if this court found that Oscar Pistorius acted with gross negligence, what precedent does a five year sentence set? ”

Gerrie Nel yesterday told the court that for what Oscar did, the sentence was shockingly inappropriate. The state believes that Oscar should have been given a ten year sentence for Culpable Homicide. “Oscar Psitorius’ sentence sets bad precedent for sentences of other people convicted of gross negligence,” he explained.
